Judgment text excerpt

The Supreme Court interpreted Rule 49(c) of the Drugs (and Cosmetics) Rules 1945, clarifying that 'post graduate training' refers to training received after obtaining a degree in medicine or science, rather than training specifically in a post graduate institution. The Court held that the requirement of one year’s post graduate training does not necessitate enrollment in a post graduate course, thus allowing the appellants, who had laboratory training, to qualify for the position of Drug Inspectors. The High Court's decision to set aside the selection was overturned, affirming the eligibility of the appellants.
