The Supreme Court upheld the dismissal of a ticket-examiner from the State Road Transport Corporation for major misconduct under Standard Standing Order 12(b) of the Madhya Pradesh Industrial Employment (Standing Orders) Rules, 1963. The Court found that the appellant colluded with the conductor in depriving the Corporation of its earnings, thus constituting dishonesty. Although the Labour Court identified defects in the domestic enquiry, it justified the dismissal based on evidence presented, ruling that the dismissal relates back to the original order, denying the appellant back wages.
