The Supreme Court held that the relationship of landlord and tenant is not extinguished by the Bombay Merged Territories Miscellaneous Alienations Abolition Act, 1955, as there is no provision in the Act that affects the application of the Bombay Tenancy & Agricultural Lands Act, 1948, particularly Section 32, which grants tenants the right to purchase land. The Court clarified that the Abolition Act aimed to eliminate intermediaries, not to evict tenants, and affirmed that tenants retain their rights under the Tenancy Act despite the provisions of the Abolition Act. The appeal was dismissed, upholding the lower courts' decisions.
