Judgment text excerpt
The Supreme Court held that the appellants, Ninaji and Raoji, were guilty of an offence under Section 325 IPC for causing grievous hurt, as they did not have the intention to inflict fatal injuries on the victim, Bhonaji. The Court found that while one injury was fatal, the others were not on vital parts of the body, indicating a common intention to cause grievous hurt rather than murder. The conviction under Section 302 read with Section 34 IPC was set aside, and the appellants were sentenced to rigorous imprisonment for five years under Section 325 IPC and six months under Section 147 IPC.
