The Supreme Court held that under Section 115(7) of the States Reorganisation Act, 1956, the dismissal of employees must be conducted by an authority of equal or higher rank than their appointing authority. The Court found that the respondents, who were bus conductors transferred to the State of Mysore, could not be dismissed by the Divisional Controller, a subordinate authority, as this violated their rights under Article 311 of the Constitution. The dismissal was thus deemed invalid, and the High Court's decision to strike down the dismissal was upheld.
