The Supreme Court held that under Section 17(1) of the Land Acquisition Act, the urgency clause allows for the dispensation of objections under Section 5A only if the land is arable or waste. The appellant, a tenant of Plot No. 428, could not challenge the notification since the owner of the adjacent Plot No. 436 did not object. The Court distinguished Sarjoo Prasad v. State of U.P. (AIR 1965 SC 1763) and affirmed that only those with a direct interest in the land can object to the acquisition process under Section 5A.
