Judgment text excerpt

The Supreme Court interpreted the Bombay Industrial Relations Act, 1946, specifically sections 42(4), 78(1)(A)(a)(i), and 79(1) and (3), along with rule 53, to clarify that a dispute under section 78(1)(A)(a)(i) can be deemed to have arisen after the expiration of the initial 15-day period if a mutually fixed extension is agreed upon. The Court held that such an extension can be established even after the initial period has lapsed, thus allowing the application filed on June 7, 1973, to be considered timely. The appeal was allowed on the basis that the High Court's interpretation of the extension was correct, affirming the Labour Court's jurisdiction to entertain the application.
