The Supreme Court ruled that the Rajabagan Dockyard, operated by the Corporation, was not a newly set up establishment under Section 16 of the Payment of Bonus Act, 1965. The Court held that the Industrial Tribunal erred in determining the Corporation's status as a successor in interest, as the establishment retained its identity, address, and registration number under the Factories Act. Consequently, the workmen were entitled to bonus for the years 1967-68 and 1968-69, as the establishment was not considered new despite the change in employment terms.
