The Supreme Court ruled that amendments to the Mysore Silk Worm Seed and Cocoon (Regulation of Production, Supply and Distribution) Act, 1960, which imposed additional restrictions on trade, required Presidential sanction under Article 304(b) of the Constitution. The Court held that a petition under Article 32 is maintainable to challenge non-compliance with this requirement. The Court found that the amendments did not merely reiterate existing restrictions but introduced new penalties, thus necessitating fresh approval from the President.
