Judgment text excerpt

The Supreme Court examined the constitutional validity of the Emblems and Names (Prevention of Improper Use) Act, 1950, particularly Sections 3, 4, and 8, in relation to the trade name 'Chhatrapati Shivaji Bidi'. The Court held that the Act does not suffer from excessive delegation of legislative power and does not violate the petitioners' rights under Article 19(1)(f) and (g). The Court upheld the prohibition on the use of the name and pictorial representation, affirming the legislative competence of Parliament under Entries 49 and 97 of List I and Entry 26 of List II of Schedule VII of the Constitution.
