The Supreme Court held that under Section 13 of the Karnataka Municipalities Act, 1964, the State Government has the authority to determine the electoral divisions and the corresponding voters' lists. However, the Court clarified that any discrepancies in the electoral roll must be rectified under Section 22 of the Representation of the People Act, 1950, and cannot be corrected by the Returning Officer during the preparation of the voters' list. The Court upheld the High Court's decision that the State Government exceeded its powers by cancelling the election calendar, thereby affirming the validity of the electoral process as initially set by the Returning Officer.
