Judgment text excerpt

The Supreme Court held that Section 2A of the Industrial Disputes Act, 1947, allows disputes arising from the termination of an individual workman's service to be deemed industrial disputes, regardless of union involvement. The Court found that the Labour Court's decision to reinstate the respondent was justified due to the vagueness of the charges and the defects in the domestic enquiry. The appeal was allowed on the basis that the Labour Court's interference was warranted, thereby overruling P. Janardhana Shetty v. Union of India regarding the interpretation of disputes under Section 2A.
