Judgment text excerpt

The Supreme Court held that under Section 8(1) of the Maintenance of Internal Security Act, 1971, the appropriate Government must consider the representation made by the detenu with an unbiased mind, but it is not required to provide a reasoned order. The Court affirmed that the power of preventive detention conferred on the District Magistrate does not violate Article 19 of the Constitution, and the absence of charge sheets does not render the detention order mala fide. The petition was dismissed, upholding the legality of the detention order.
