The Supreme Court held that the Office Memorandum dated June 22, 1949, does not prevent the Government from establishing separate provisions for the constitution and maintenance of the Central Secretariat Service. The Court ruled that the classification made in the instructions is not unreasonable and does not violate Articles 14 and 16 of the Constitution. It was determined that temporary Assistants, once absorbed into the service, cannot have their seniority superseded by later direct recruits, as this would constitute discrimination under Article 16.
