Judgment text excerpt

The Supreme Court addressed the interpretation of Sections 81(3), 86(1), and 116-A of the Representation of People Act, 1951, in the context of an election petition. The Court held that the action of the third respondent, even if collusive or fraudulent, did not equate to a withdrawal of the election petition, and thus the provisions for continuance in case of withdrawal or abatement were not applicable. The Court allowed the appellant to challenge the High Court's refusal to permit intervention but did not permit a challenge to the dismissal of the election petition under Section 86.
