The Supreme Court held that the appointment of the Assistant Settlement Commissioner under the Displaced Persons (Compensation and Rehabilitation) Act, 1954, could only be terminated by the Central Government as per Article 310(1) of the Constitution. The State Government lacked the authority to terminate the services of the first respondent since the appointment was made by the Central Government. The Court upheld the High Court's decision that the termination was invalid and that the respondent was entitled to arrears of salary until February 18, 1959.
