The Supreme Court held that the conditions of service for employees of the State of Bombay included the possibility of changes by the reorganised State of Gujarat, as per Article 309 of the Constitution. The Court ruled that the State of Gujarat had the authority to impose the G.D.C. & A. examination as a requirement for promotion, despite the absence of such a rule prior to the reorganisation. The appeal was allowed, affirming that the successor states inherit the powers of the reorganised state regarding service conditions under Section 87 of the Bombay State Reorganisation Act, 1960.
