The Supreme Court held that under Section 4(1) of the Madhya Pradesh Prathmik Middle School Tatha Madhyamik Shiksha (Pathya Pustakon Sambandhi Vyavastha) Adhiniyam, 1973, the State Government has the authority to prescribe text books, provided there is prior consultation with the Board of Secondary Education. The Court clarified that the power to prescribe courses does not inherently include the power to prescribe text books. The judgment affirmed the validity of the 1973 Act and the notifications issued thereunder, dismissing the petitioner's claims regarding the lack of statutory authority for the State Government's actions.
