The Supreme Court held that the personal liability of directors and officers does not fall under Section 4(1)(a)(iv) of the Bombay Relief Undertakings (Special Provisions) Act, 1958. The Court clarified that the responsibility to pay contributions to the Employees Provident Fund is personal to the directors, and their prosecution under paragraph 76(a) of the Employees Provident Funds Scheme, 1952, cannot be stayed by the notification declaring the company a relief undertaking. The Court dismissed the appeal, affirming that individual obligations of directors are not covered by the immunity provided to the undertaking.
