Judgment text excerpt

The Supreme Court held that the cash allowance known as Tainat, granted to the respondent's ancestors by the Peshwas and continued by the Ruler of Jamkhandi, was subject to the sovereign powers of the Ruler, who had the authority to convert it from a permanent to a life allowance. The Court emphasized that prior to the integration of Indian States, Rulers had uncontrolled sovereign powers without constitutional limitations. Consequently, the High Court's ruling that the allowance was hereditary was overturned, and the appeal by the State Government was allowed.
