The Supreme Court held that the Punjab Co-operative Subordinate Service Rules, 1936, which stipulate that seniority is based on passing a departmental examination, were validly applied in the case of the appellants and respondents. The Court found that the Central Government's memorandum dated 11 May 1957 constituted the necessary prior approval under Section 115(7) of the States Reorganisation Act for any changes in service conditions. Consequently, the appellants, having passed their examination after the respondents, were rightly classified as juniors, and their appeal was dismissed.
