The Supreme Court examined the constitutionality of various provisions of the Gujarat University Act, 1949, particularly Sections 5, 33A, 39, 40, and 41. The Court held that the provisions do not violate Articles 29 and 30 of the Constitution, which guarantee the right of minorities to establish and administer educational institutions. The Court emphasized that while the University has the authority to regulate education, it must not infringe upon the rights of minority institutions to manage their affairs independently.
