The Supreme Court held that under Section 46 of the Motor Vehicles Act, 1939, the Regional Transport Authority has the power to substitute a successor in place of a deceased applicant for a stage carriage permit. The Court affirmed the High Court's ruling that the firm M/s. Ram Autar Lal Jain was a distinct entity from the heirs of the deceased, thus the application could not be treated as one made by the heirs. The appeal was dismissed, upholding the decisions of the Appeal Board and the Minister of Transport.
