The Supreme Court held that the Regional Transport Authority (RTA) could not grant permits for the longer route without first fixing the strength of that route, as mandated by Section 47(3) of the Motor Vehicles Act, 1939. The Court found that the RTA's decision to reduce the strength of the shorter route from 25 to 9 was illegal, and that the shorter and longer routes existed separately. Consequently, the Court allowed the appeal of the third group, reinstating the validity of the eight permits granted to them.
