Judgment text excerpt

The Supreme Court held that the plaintiffs, as next reversioners, had sufficient title to the Bhumidari plots after the death of their uncle Markandey and his widow Jagdamba. The Court found that the High Court erred in applying the two-year limitation period under the Uttar Pradesh Zamindari Abolition and Land Reforms Rules, 1952, instead of the 12-year period prescribed by the Limitation Act, 1908. The Court reversed the High Court's dismissal of the suit, holding that the suit was indeed filed within the permissible time frame as plaintiff No. 1 attained majority in 1955.
