The Supreme Court held that the Deputy Registrar's order suspending the President and committee of management of the Jahangirabad Cooperative Marketing Society was invalid as no proceedings for supersession had been initiated in accordance with Section 35(1) of the Cooperative Societies Act, 1965. The Court clarified that the power to appoint an administrator under Section 35(2) is contingent upon the commencement of supersession proceedings. Consequently, both the interim suspension and the appointment of the administrator were quashed, leading to the allowance of the writ petition and appeal.
