The Supreme Court held that under Section 18(1) of the U.P. Zamindari Abolition and Land Reforms Act, 1950, the grove in question, being an intermediary's grove, resulted in the extinguishment of the appellant's rights upon vesting with the State. The Court ruled that the lessee of an intermediary's grove does not qualify as an intermediary and thus has no rights in the grove land. Furthermore, the Court clarified that the dismissal of a related appeal does not constitute res judicata as the issues were distinct.
