The Supreme Court held that under Section 92 of the Delhi Municipal Corporation Act, 1957, the power to appoint municipal employees lies with the General Manager (Transport), and Section 95(1) prohibits any subordinate authority from removing an employee appointed by the General Manager. The Court affirmed that the Assistant General Manager, despite having delegated powers, could not remove the respondent from service as he was appointed by the General Manager. The appeal was dismissed, upholding the Labour Court's decision that the removal was invalid.
