Judgment text excerpt

The Supreme Court held that under Section 3(1) of the Hyderabad Abolition of Inams Act, 1955, all rights and interests in inam lands vested absolutely in the State from July 20, 1955, thus disentitling the landlord from claiming possession under Section 32(2) of the Hyderabad Tenancy and Agricultural Lands Act, 1950. The Court distinguished the case from Dattatraya Sadashiv v. Ganapati Raghu, clarifying that the relationship of landlord and tenant continued until July 1, 1960, but the landlord's notice to quit was ineffective for claiming possession thereafter. The High Court's order was set aside, and the case was remitted for re-decision.
