The Supreme Court upheld the High Court's decision to quash amendments to the Mysore State Accounts Services (Recruitment) Rules, 1959, which sought to create discriminatory promotional chances among members of the same service, violating Articles 14 and 16(1) of the Constitution of India. The Court ruled that the rule-making power under Article 309 cannot be used to legitimize unconstitutional discrimination. The amendments were deemed ultra vires as they attempted to disintegrate an integrated service without justifiable rational criteria for promotion differences.
