Judgment text excerpt
The Supreme Court set aside the Division Bench's order in Writ Appeal No. 113 of 1967, ruling it violated natural justice as it was ex-parte and could not bind the workmen. The Court found the clarification by the learned single Judge in CMP No. 7125 of 1967 to be erroneous, as it contradicted the appellate court's binding order. Consequently, the second award of the Labour Court dated May 25, 1968, was also annulled, as it was issued without proper consideration of the learned single Judge's judgment, leading to the quashing of the High Court's judgment dated July 7, 1970, against the second award.
