The Supreme Court examined the constitutionality of Section 212 of the Bombay Provincial Municipal Corporation Act, 1949, which allows the Municipal Commissioner to require the demolition of buildings within the regular line of a public street. The Court held that while the Act provides for compensation under Section 216, it fails to specify the principles and manner of determining such compensation, violating Section 299 of the Government of India Act, 1935, and Article 31 of the Constitution. Consequently, the Court set aside the High Court's order and directed the case to be disposed of according to law.
