Judgment text excerpt

The Supreme Court upheld the convictions of the appellants under Sections 218, 477A, and 409 of the Indian Penal Code, as well as Section 5(2) of the Prevention of Corruption Act, for preparing false documents and committing criminal breach of trust. The Court clarified that a subsequent rectification of work or disbursement of funds does not absolve the accused of prior dishonest misappropriation as defined in Section 403 IPC. Furthermore, the Court ruled that non-compliance with Section 5A of the Prevention of Corruption Act does not invalidate the trial unless it results in a miscarriage of justice, which was not established in this case.
