Judgment text excerpt
The Supreme Court held that the three ex-Judges' claims for pensions expressed in Pound Sterling were not legally enforceable. The Court interpreted Section 18 of the 1954 Act and Article 221 of the Constitution, concluding that the 1937 Order did not create a vested right for the Judges to receive pensions in Sterling or to convert them at market rates. The Court affirmed that the provisions of the 1954 Act, which specified pensions in rupees, were applicable and valid, thus dismissing the appeals of the ex-Judges.
