The Supreme Court clarified the interpretation of Section 44(3)(b) of the Motor Vehicles Act, 1939, holding that the State Transport Authority can assume the functions of the Regional Transport Authority in three scenarios: (1) when no Regional Transport Authority is functioning, (2) when the State Transport Authority deems it fit to perform duties for routes common to multiple regions, and (3) upon request from the Regional Transport Authority for inter-regional routes. The Court found the High Court's interpretation limiting the scenarios to two as erroneous, thereby dismissing the appeal and upholding the High Court's directive to the Regional Transport Authority to process the application for a stage carriage permit.
