Judgment text excerpt

The Supreme Court held that in Hindu joint families, the presumption is that members are joint unless proven otherwise. The appellant's claim of separation from the family was not substantiated by evidence, and thus he remained entitled to a share in the family property. Furthermore, the court found no evidence to support the claim that the father intended to gift fixed deposit amounts to the first respondent, as the father retained ownership until his death, and the transfer to joint names did not indicate an exclusive gift.
