The Supreme Court held that under Section 43 of the Madras Motor Vehicles (Taxation of Passengers and Goods) Act, 1952, the conditions of permits held by operators are statutorily amended to include enhanced fares once a notification is issued. The Court found that the directions given by the Government authorized operators to collect enhanced fares, and thus, there was no impediment preventing them from doing so despite the permits not being formally amended. The judgment upheld the legality of the surcharge imposed under the amended Act, affirming the operators' right to collect the enhanced fares.
