The Supreme Court held that the dismissal of Ram Kishan, a Foot Constable, was invalid due to non-compliance with the mandatory provisions of Punjab Police Rule 16.38, which requires prior information to the District Magistrate. Although the court found that the Superintendent of Police (Traffic) was competent to dismiss the plaintiff, the failure to adhere to Rule 16.38 rendered the dismissal void.
