Judgment text excerpt

The Supreme Court held that under Section 33C(2) of the Industrial Disputes Act, 1947, a Labour Court acts as an executing court and is competent to interpret an award when there is a dispute regarding its rights or interpretation. The Court ruled that the High Court erred in directing the Labour Court to compute dearness allowance without considering the maximum limit established by prior awards. The appeal by the company was allowed, affirming the Labour Court's decision to limit the dearness allowance to Rs. 350.
