Judgment text excerpt

The Supreme Court held that under Section 211 of the Indian Companies Act, 1956, a balance sheet must reflect a true and fair view of a company's financial state. The Court ruled that the Wealth Tax Officer, under Section 7 of the Wealth-tax Act, is justified in accepting the asset valuation shown in the balance sheet unless the assessee provides acceptable reasons for any inflation. In this case, the assessee failed to demonstrate the necessity for inflating asset values for issuing bonus shares, thus the Wealth Tax Officer's assessment based on the original figures was upheld.
