The Supreme Court held that the 1963 memorandum allowing retention of government servants beyond the age of 55 years did not violate Article 14 of the Constitution. The Court clarified that retention was based on public service exigencies and the individual's physical fitness and efficiency, thus treating all government servants equally. The 1968 memorandum superseded the 1963 memorandum, and no legal right existed for government servants to continue in service beyond the age of 55, as per Fundamental Rule 56(a). The appeal by the State was allowed, overturning the High Court's decision.
