Judgment text excerpt

The Supreme Court upheld the decision of the Bihar School Examination Board to cancel the examination results at a particular center due to evidence of unfair means, as per Section 9(3) of the Bihar School Examination Board Act, 1952. The Court ruled that the Chairman acted within his powers during an emergency and that no principle of natural justice was violated since the evidence of malpractice was clear and did not require a hearing for the examinees. Consequently, the High Court's order to publish the results was set aside, allowing the candidates to reappear for the examination.
