The Supreme Court held that Entry 80 in List 1 of the 7th Schedule of the Constitution empowers the Central Legislature to extend police powers to any area outside a State with the consent of that State. The Court clarified that the term 'State' includes Union Territories following the Constitution (Seventh Amendment) Act, 1956. The Delhi Special Police Establishment Act, as adapted, allows for such extensions, and the consent given by the Maharashtra government for investigations under Sections 409 and 477A IPC was valid. The appeal challenging the powers of the Special Police Establishment was dismissed.
