The Supreme Court held that the first power of attorney executed by V was invalid due to lack of proper authentication as required under Section 33 of the Indian Registration Act. The Court dismissed the appellants' suit for declaration, as they did not seek cancellation of the Collector's order or an injunction, thus failing to meet the requirements of Section 42 of the Specified Relief Act.
