The Supreme Court held that a contract made by the Bombay Municipal Corporation without following the formalities prescribed under Section 74(2) of the Bombay Provincial Municipal Corporations Act, 1949, is not binding. The Court ruled that despite the absence of a Transport Committee due to pending elections, the requirement for a seal and attestation by committee members must be adhered to. However, the appellant was entitled to compensation under Section 70 of the Indian Contract Act, 1872, for the value of goods supplied, as the Corporation had accepted the goods and benefited from them.
