The Supreme Court held that a master does not have an implied right to suspend a servant pending an enquiry unless such power is expressly provided in the contract, statute, or service rules. In this case, the Madhya Pradesh Government Servants (Temporary and Quasi-Permanent Service) Rules, 1960, did not authorize suspension, thus the appellant's resignation was valid and effective. Consequently, the respondent could not initiate disciplinary proceedings against the appellant after his resignation was communicated.
