The Supreme Court ruled that under the U.P. Encumbered Estates Act, 1934, the rights of mortgagees were extinguished, and a decree under Section 14(7) was merely a simple money decree, executable only per the Act's provisions. The Court held that bhumidhari rights, created under the U.P. Zamindari Abolition and Land Reforms Act, 1951, are not proprietary rights and can be executed against as per Section 24 of the Encumbered Estates Act. The Court affirmed that the execution against the bhumidhari rights was permissible as there was no prohibition in the Abolition Act against such execution, thus allowing the respondents to proceed against the appellants' rights.
