Judgment text excerpt

The Supreme Court held that a suit for eviction filed by a landlord after obtaining permission from the District Magistrate under the U.P. (Temporary) Control of Rent & Eviction Act, 1947, remains maintainable even if the State Government subsequently revokes that permission under Section 7-F. The Court clarified that the maintainability of the suit is not contingent upon the State Government's order, as the legislature did not impose such a condition. Thus, the suit filed by the landlord was deemed valid despite the revocation of permission by the State Government.
