The Supreme Court held that under Section 13(1)(e) of the Rajasthan Premises (Control of Rent & Eviction) Act, a mere increase in rent does not constitute a new tenancy. The Court found that the High Court erred in treating the tenancy of six shops as integrated and in concluding that two shops were sub-let without permission. The appellant was to be ejected from the two shops only, as the first two courts had correctly determined that the increase in rent did not imply a new lease and that the issue of sub-letting was not adequately pleaded.
