The Supreme Court held that the import of gold in contravention of Section 8(1) of the Foreign Exchange Regulation Act, 1947 is punishable under Section 167(81) of the Sea Customs Act, 1878, establishing that violations of the Foreign Exchange Regulation Act attract provisions of the Sea Customs Act. The Court affirmed the convictions for criminal conspiracy under Section 120B IPC and substantive offences under Section 167(81), ruling that the prosecution adequately established the conspiracy and that the trial court's decisions regarding witness testimony and privilege claims did not result in a miscarriage of justice.
